Bankruptcy In the Economic Slide

I am so tired of hearing people who do not understand bankruptcy commenting on bankruptcy as though they DO understand the subject. I intend to post a few items about the background and benefits to society in general of having such a tool available to debtors (and creditors).

I will prepare a few thoughts for this space next week.

09-15-09 Depositions

Today I went down to Glendale for the deposition of one of my clients. It involved a personal injury auto collision with State Farm as the insurance carrier for the defendant. Defense counsel asked his questions in 45 minutes and we were done. I like attorneys who are brave enough to get down to business, ask what they want to know and finish. I am going to prepare a brochure for clients to help them in depositions. They need it. This process makes many of them so nervous.

New Client - Bankruptcy

I met with a sweet couple today, Spanish speakers. They run their own business and have fallen prey to the downturn in the economy. Their credit cards are out of control and they have to file a bankruptcy case. It's not that they planned to avoid paying creditors. They believed all along that they would be making enough money to pay them eventually. The credit is pushed on these people and it is too easy. They don't have a reason NOT to do it. Now they feel guilty and they feel like bad people. I am going to help them through this and I am going to show them that we believe in giving people a second chance. It does no one any good to force these people to lose hope and to live their lives out paying a minimal amount month to month, never again able to see beyond their credit prison. More later on this...

Page Turned

President Obama doesn't scare me as much as he seems to scare other conservatives. I am anxious and interested to see what he does with the reigns. I am happy to see a black man sitting in that office. I don't care so much about the message it sends to France, but I think it will be a good thing for Detroit and L.A.

My biggest fear has to do with the fact that he is a rookie. After he is sworn in and saunters into the Oval Office, who is gonna be waiting for him? Nancy Pelosi and Harry Reed, two of the worst politicians of my lifetime (imho). Will he play to the middle (as he campaigned) or fall back to the leftie base? We will see.

I was also pleased to see Prop 8 pass in California. I believe that marriage should be limited to one man and one woman. That being said, I still have the uneasy feeling that we have just stuck our pudgy little finger in the dike... The cracks in the dam are letting a lot of water through.

I can't understand how Prop 8 could pass and Prop 4 (parental notification of a minor's abortion) could fail, but it did. California is a little schizo at times.
